Draft — not yet reviewed by counsel
The short version: you stay in control of what’s posted, you only connect listings you’re allowed to manage, and you never use Reply Hearth to game reviews.
Contents
1.The agreement
These terms are an agreement between you and BioRust Studios, LLC for your use of Reply Hearth. If you use Reply Hearth for a business or on a client’s behalf, you accept them for that business too, and confirm you can bind it.
Our Privacy Policy and, for business customers, our Data Processing Addendum (to be published) are part of these terms.
2.Your account
- You must be at least 18 and give a working email address, which you verify.
- Keep your password safe. You are responsible for activity in your account.
- Tell us promptly if you think someone else has access to it.
4.Suggested mode and consent to automated replies
New locations and apps start in suggested mode: we draft replies and nothing is posted until you approve it.
You can turn on automatic replies separately for each location or app and each star rating. Each time you do, we record who made the change, when, and the exact settings. Automatic replies for 1–3 star reviews need an extra confirmation. You can turn automatic replies off, or pause them for your whole workspace, at any time.
Even when automatic replies are on, a review that trips a safety rule is held for a person instead of being posted.
5.Your responsibility for replies
You are the publisher of every reply posted from your account, whether you wrote it, approved a draft, or allowed it through your automatic-reply settings. That includes what your voice instructions and facts and policies tell us to say.
We may block, hold or decline to post content that breaks these terms, a platform’s rules or the law.
6.AI-generated drafts
- Drafts are written with AI. They may be inaccurate, incomplete or unsuitable, so read them before approving.
- We can’t guarantee that a platform will accept, publish or keep any reply.
- Where we offer it, you may add an “AI-assisted” note to your replies.
7.Acceptable use
You agree not to use Reply Hearth to:
- write, buy or solicit fake reviews, or post reviews of your own business;
- gate reviews (asking only happy customers to review) or offer anything of value in exchange for a review, or for changing or removing one;
- threaten, harass or intimidate reviewers, threaten legal action in a reply, or publicly accuse a reviewer of posting a fake review;
- enter patient or client information, or other sensitive personal information, in voice instructions, facts and policies, or notes;
- break the rules of the platforms you connect, including Google Business Profile and Maps content policies, the Business Profile API policies, Google Play and App Store rules, or the FTC’s rule on consumer reviews and testimonials;
- get around our safety holds and guardrails, or let anyone post replies through Reply Hearth by automated means we don’t provide.
8.Healthcare and confidential professions
For healthcare practices and other confidential professions, Reply Hearth is built to avoid disclosing patient information: replies never confirm or deny a relationship with the reviewer, 1–3 star reviews are always held, and only 5-star reviews can be answered automatically.
Before turning on automatic replies in this mode you must accept a separate acknowledgment. The service is not covered by a business associate agreement unless we have signed one with you separately.
9.Third-party platforms
Reply Hearth depends on Google, Apple and other providers whose services we don’t control. They may change, limit or withdraw access to their services at any time, and we may have to change or remove features as a result. Reply Hearth is not affiliated with, sponsored or endorsed by Google or Apple.
For App Store accounts we act as your service provider, solely on your behalf, under terms at least as protective of Apple as your agreement with Apple.
Google Play, Google Maps and Android are trademarks of Google LLC. Apple and App Store are trademarks of Apple Inc. App names and icons belong to their owners. The Android robot is reproduced or modified from work created and shared by Google and used according to terms described in the Creative Commons 3.0 Attribution License.
10.Your data, retention and disconnection
- We keep review content from the platforms for at most 30 days.
- When you disconnect a location or app, we stop accessing it and remove its access tokens or keys within 7 business days, and usually straight away.
- When your account ends, we delete your data within 30 days. Details are in the Privacy Policy.
11.Plans and payment
Paid plans, prices and billing terms will be listed on our pricing page. Payments are handled by Paddle as merchant of record.
12.Suspension and termination
You can delete your account at any time in Settings. Replies already posted stay on the platforms.
We may suspend or end your access if you break these terms, if a platform requires it, or to protect reviewers, other customers or the service. Where we can, we’ll tell you first and give you a chance to fix the problem.
13.Disclaimers
Reply Hearth is provided “as is”. To the extent the law allows, we make no warranties about it being uninterrupted, error-free or fit for a particular purpose.
14.Limitation of liability
To the extent the law allows, our total liability is limited to what you paid us in the 12 months before the claim, and we are not liable for indirect or consequential losses.
We are not responsible for actions taken by Google, Apple or other platforms, including suspending a listing or app, removing reviews or replies, or changing their APIs.
15.Indemnity
You will cover our reasonable losses from claims caused by replies you published, content you gave us, or your breach of these terms.
16.Your right to review us
Nothing in these terms stops you from reviewing Reply Hearth honestly, anywhere. We don’t use non-disparagement clauses.
17.Platform reviews of our service
Platforms such as Google may ask to review how Reply Hearth works. We may give them a demonstration account that uses anonymized data only, never your reviews.
18.Changes and contact
If we make a material change to these terms, we’ll email account owners at least 30 days before it takes effect. Governing law and dispute terms will be added before launch.
